The Court of Appeal in Putrajaya today upheld the 25 years jail on two men for committing a terrorist act by exploding a grenade at Movida nightclub in Puchong in 2016, injuring eight people.
Justice Yaacob Md Sam, who led a three-member bench, unanimously dismissed the appeals by Imam Wahyudin Karjono and Jonius Ondie @ Jahali on the sentence after ruling that their appeals did not have merit.
"We find that the trial judge did not err in sentencing the appellants to 25 years jail," said Justice Yaacob who presided on the bench with Justices Zabariah Mohd Yusof and P Ravinthran.
Imam Wahyudin, 23, from Puchong and Jonius, 27, a Sabahan were appealing against the High Court decision in 2017 to sentence them to 25 years jail after they pleaded guilty to the charge of throwing the hand grenade at Movida Boulevard Sdn Bhd entertainment centre at IOI Boulevard in Bandar Puchong Jaya, Puchong, at 2am on June 28, 2016.
They were also sentenced an additional 10 years jail each for giving support to the Islamic State (IS) group.
High Court judge Nordin Hassan had ordered the two men to serve the jail sentences concurrently from the date of their arrest. Imam Wahyudin, a factory worker, was arrested on June 29, 2016, while Jonius, unemployed, on July 1, 2016.
Both men, who were unrepresented, pleaded the court to lower their jail sentences.
DPP K Mangai urged the court to maintain the 25 years jail as the offence they committed was serious where eight people were injured and the explosion had also caused damage to the property.
