Sabah Barisan Nasional chairperson Musa Aman today filed a writ of summons against Yang Dipertua Negeri Tun Juhar Mahiruddin and Parti Warisan Sabah president Mohd Shafie Apdal seeking a declaration that he (Musa) remains the lawful chief minister of Sabah.
The writ also seeks a declaration that the swearing in of Mohd Shafie as chief minister by the Yang Dipertua Negeri is unconstitutional.
It also seeks a declaration that any and all acts by Shafie whilst purporting to be the chief minister are also null, void and of no effect.
The writ was filed by Messrs F.T. Ahmad & Co. who are acting for Musa and it named Tun Juhar and Mohd Shafie as the first and second respondents, respectively.
Under the Rules of Court 2012, once the writ is served, both Juhar and Shafie have 14 days to enter an appearance.
Musa was sworn in as chief minister on May 10 and Mohd Shafie on May 12.
