The Malaysian Bar is seeking the removal of Chief Justice Md Raus Sharif and Court of Appeal President Zulkefli Ahmad Makinudin from their present offices.
This is among the contents of an originating summons the Bar had filed at the Kuala Lumpur High Court on Oct 10, naming the two judges and former chief justice Arifin Zakaria, as defendants.
The suit also seeks to nullify the appointment of Raus and Zulkefli as additional judges.
In addition, the Bar is seeking a declaration that Arifin's advice, as the chief justice on March 30, that Raus and Zulkefli be appointed as additional judges under Article 122(1A) of the Federal Constitution, is unconstitutional and void.
It further asked for a declaration that the appointment of both Raus and Zulkefli as chief justice and Court of Appeal president, respectively, is unconstitutional and void.
The matter came up for case management today before High Court registrar Firdauz Sidqi Sharil Azli, where lawyer Steven Thiru appeared for the Bar, while senior federal counsel Suzana Atan represented the judges.
Firdaus fixed Nov 9 for another case management before Justice Azizah Nawawi.
The Bar's action is in pursuant to the resolution it had adopted at its extraordinary general meeting (EGM) on Aug 3.
