DAP gives ROS 48 hours to hand in letter on CEC re-election

DAP has given the Registrar of Societies (ROS) 48 hours to hand in its letter instructing the party to hold the re-election for its central executive committee (CEC).

"If it doesn't, either by letter or otherwise, respond by end of office hours this Friday, DAP will have no choice but to consider its options to deal with this position," DAP legal bureau chief Gobind Singh Deo said in a statement today.

He said the DAP cannot hold a CEC re-election without official communication from the ROS.

"Forcing us to (hold re-election without a letter) would be most unreasonable.

"The letter is therefore absolutely essential to us. It must set out clearly any decision made and the orders or directions we need to comply with," Gobind said.

Deputy Prime Minister Ahmad Zahid Hamidi said last Sunday that the ROS would be sending its letter to the DAP on the CEC re-election this week.

Last Friday, the ROS ordered the DAP to hold a fresh CEC election, stating that its 2013 re-election was not in accordance with the law.

The DAP had, in 2013, voluntarily held a CEC re-election after it said an excel spreadsheet error affected the results of the initial election held on Dec 15, 2012.

The result of the re-election was communicated to the ROS on Nov 8, 2013, pursuant to the provision of its constitution and the Societies Act 1966.

However, the ROS did not recognise the 2013 re-election outcome either and the DAP took it to court.

The lawsuit was dropped after an ROS lawyer told the court that "...the ROS recognises that the DAP CEC elected on Sept 29, 2013, may carry out all its powers, functions and duties in the administration of the daily affairs of the DAP in accordance with the constitution of the DAP".
