Minister in the Prime Minister's Department Azalina Othman Said has insisted that questions related to the RM2.6 billion scandal can't be asked in Parliament as it amounts to sub judice.
"My statement yesterday was made in my capacity as minister in charge of parliamentary affairs.
"I wish to state that the (RM2.6 billion issue) is subject to Standing Order 23(1)(g) in which it is sub judice if discussed in any forum," Azalina said in a statement today.
This is despite protestations from opposition lawmakers, including Puchong MP Gobind Singh Deo that the matter is not sub judice yet.
Gobind said this is because the judicial review application filed by the Malaysian Bar on the matter has not yet been granted leave.
The DAP lawmaker also pointed out that a different Standing Order states that only the Speaker can rule a question is sub judice after hearing it.
Sub judice is a latin term meaning "under judgment", which means that a particular case or matter is under trial or being considered by a judge or court.
Azalina had issued the blanket ban on RM2.6 billion questions following the Bar's decision to file a judicial review on attorney-general Mohamed Apandi Ali's decision to clear Prime Minister Najib Abdul Razak of any misconduct in the scandal.
Najib has denied misusing public funds for personal gain and dismissed such allegations as a plot to topple him.
