The Court of Appeal today freed the taxi driver who had allegedly ferried the suspected killer of AmBank founder Hussain Najadi.
The court allowed Chew Siang Chee’s appeal against his conviction and sentence, reports The Star Online .
Court of Appeal president Justice Md Raus Sharif said the decision was unanimous and that the court had agreed with the defence that the charge was not proven.
Chew had filed an appeal against his conviction and 14 years' jail term and six strokes of the rotan for possessing a Walther pistol, a magazine, and four bullets.
The offences were allegedly committed at Desa Cindaimas condominium on Jalan Kuchai Lama at about 5.45pm on Aug 3, 2013.
A year later, the 46-year-old was sentenced by the Sessions Court to 10 years’ jail and six strokes of the rotan for possessing the pistol and another four years for the possession of live bullets.
Chew then filed an appeal to set aside his conviction and sentence at the High Court but was dismissed by Justice Mohd Azman Husinin in September 2013.
The appellate court last year ordered the High Court to rehear Chew’s appeal before a different judge.
Hussain, 76, died, while his wife was seriously injured after being shot when they emerged from the Kuan Yin Temple in Kuala Lumpur on July 29, 2013.
The shooter, Kong Swee Kuan, was sentenced to death in 2014 for the murder.
