Former PKR deputy secretary-general P Jenapala's suit to stop the party from announcing the winner of the election for the deputy presidency will be heard on Thursday.

Kuala Lumpur High Court judge Justice Aziah Ali set the date in chambers today.

PKR’s lawyers have also agreed that no formal announcement of the election results will be made until Nov 28, when the party holds its national congress in Shah Alam.

This is also pursuant to Article 14(3) of the party constitution, said the respondent's lawyer, Ranjit Singh.

“We indicated to the judge, as provided under the PKR constitution, that the official announcement can only be declared at its national congress, which be held from Nov 26-28," he said.

NONE "Therefore, we have reached a mutual understanding on the injunction application."

Last Thursday, Jenapala (left) had filed the suit to declare the election for deputy presidency invalid because he was not allowed to contest.

He claims that he is a life member of the party and that he has not be formally informed of his alleged expulsion from the party. As such, he feels he is eligible to run for the deputy president's post.

He also applied for an injunction to prevent PKR from declaring the candidate elected to the post.

Jenapala named president Dr Wan Azizah Ismail, her deputy Syed Husin Ali and secretary-general Saifuddin Nasution Ismail as respondents in their capacity as office-bearers.

He is also seeking damages to be assessed, costs, interests, and any other relief deemed fit by the court.

Initially, Jenapala had hired Hafarizam Wan & Aisha Mubarak to proceed with the matter.

It is understood that Jenapala engaged a lawyer that is not affiliated to any political parties later to deter allegations that his actions were politically motivated. 

“I didn’t know this earlier. Most of the lawyers I know are from PKR, DAP and PAS. Since I’m suing them it’s not right to engage those lawyers. That’s why I hired Mohd Hafarizam's firm to argue on my behalf,” he told Malaysiakini .

He noted that he since he was now being branded an “Umno man” he had decided to dissociate himself by engaging James Khong.

Khong said that if the judge is unable to rule on the matter by the end of week, they will revisit the injunction application to stop the announcement, which is scheduled for Sunday.
