A lawsuit is a normal process when one party seeks a legal remedy against another party. The defamation suit brought forth by The New Straits Times and its executives against two bloggers, therefore, is just another form of civil action at work. So what's the big deal about it?
The bid deal is that this particular lawsuit is unprecedented and it is a fight between two Davids and a Goliath. As we know, the Goliath is the NST and its executives who have strong ties to the current ruling government.
How many Malaysians today have faith to our judicial system? Our past experiences have taught us to be skeptical. We have seen an 'impossible to convict' case become 'convicted' after it went through the judicial system. Bear in mind, our court judges are civil servants and they are susceptible to strong influence from the ruling government.
They are not elected officials. Rather, they are appointed by the government. So, in other words, this defamation trial will be the trial of the Malaysian judicial system and its impartiality. Will the goal-posts keep changing position? We shall see.
And who are the Davids? It is all of us who aspire for responsible freedom of expression as found on the Internet. This is the only means available to us to find out the truth and express our dissenting opinions.
With the Internet, we can learn so much about the other side of our government and its administration. We do not have faith in the news published by the mainstream mass media which are heavily monitored, controlled and manipulated by the ruling government and its political parties.
Looking at another way, this lawsuit could be considered as The People vs. the Malaysian Government. This is it. Either we, the people, win the case and win our freedom or forever be silent.
